Apple Accuses to a Google?s Friend
Apple acusa a un amigo de Google
Apple surprised to the industry with a new legal demand about digital devices patents. The company of the magic apple filed a lawsuit against HTC for infringing on 20 Apple patents related to the iPhone?s user interface, underlying architecture and hardware. The lawsuit was filed concurrently with the U.S. International Trade Commission (ITC) and in U.S, District Court in Delaware.
In connection with this problem, Steve Jobs, CEO of Apple, said that the company will not accept competitors steal the patented inventions of his company.
HTC was the first manufacturer to install the Android operating system from Google in its machines and it is also the maker of the Nexus One of Google.
Analysts and external observers ask questions about the background of HTC and how it grew as important provider of the industry from 1997 till now.
Apple sorprendió a la industria con un nuevo pleito relativo a patentes de dispositivos digitales. La compañía de la manzana puso una demanda legal contra HTC por violación de 20 patentes suyas relativas a la interfase de usuario de iPhone, su arquitectura y su hardware. El reclamo contra el fabricante del teléfono Nexus One de Google fue presentado ante la Comisión Internacional de Comercio de los Estados Unidos (ITC) y la Corte de Distrito de los Estados Unidos en Delaware.
Steve Jobs, CEO de Apple, se refirió a la demanda legal con una expresión bastante dura, remarcando que su empresa no puede aceptar que sus competidores le roben las patentes de invención de sus productos, y dijo que los otros deben crear su propia tecnología, no robarla.
Debe recordarse que HTC fue el primer fabricante de teléfonos inteligentes que adoptó el sistema operativo Android de Google, y más recientemente acordó con Google la fabricación del Nexus One, el teléfono que meses atrás Google lanzó como producto propio al mercado con el soporte de T-Mobile con proveedor de servicios de telefonía móvil.
Frente a la demanda de Apple y al rápido crecimiento de HTC en los últimos años, surge la curiosidad de saber un poco más sobre esta empresa de Taiwán que fue fundada en 1997 por Cher Wang, HT Cho y Peter Chou. (Cher Wang es una mujer, co-chairwoman del directorio de HTC. HT Cho es director y chairman fundador de la compañía. Peter Chou es presidente y CEO de la compañía).
Desde sus inicios, HTC cimentó una sólida fundación para su crecimiento, conectándose con operadores líderes de telefonía móvil de Europa, Estados Unidos y Asía, y produciendo dispositivos digitales para los mercados de consumo de las tres regiones mencionadas. En junio del 2006, comenzó a fabricar con su propia marca. Días atrás, en el Congreso Mundial de Barcelona, fue una de las estrellas del evento introduciendo tres nuevos teléfonos digitales novedosos: HTC Legend, HTC Desire, y HD Mini.
A través una corta historia, HTC dio numerosos pasos claves para convertirse en líder de su segmento. En 1999, produjo un computador del tamaño de la palma de la mano a color. Luego, en el 2000 fabricó el primer computador personal de bolsillo de Microsoft. En forma sucesiva, HTC produjo diferentes modelos de dispositivos digitales móviles basados en Microsoft Windows Mobile. Como parte de todo ese accionar, HTC estableció importantes vínculos con Intel, Texas Instruments y Qualcomm, además desarrollando productos para Orange, T-Mobile, Vodafone, Cingular, Verizon, Sprint y NTT DoCoMo.
En resumen, el nuevo pleito contra HTC indirectamente está poniendo en veredas opuestas a Apple y Google que por años tuvieron muy buenas relaciones, tan buenas que Eric Schmidt, CEO de Google fue miembro del directorio de Apple por largo tiempo.
Ahora, debido a esta inesperada demanda legal de la empresa liderada por Steve Jobs, surgen varios interrogantes referidos a cómo realmente HTC fue creciendo rápidamente rodeado por diferentes firmas de gran prestigio. Algunos se preguntan en que medida sus pasos a través de la industria fueron todos negocios éticos. Lamentablemente la duda persistirá hasta que se conozca el veredicto del ITC.
TECH DATA
Tech Data publicó los resultados de su cuarto trimestre fiscal 2010 y de todo el año 2010. Sus ventas netas del trimestre ascendieron a 6 mil 283 millones de dólares (en notación americana: $6.28 billones), un 10% más que un año atrás. Sus ingresos netos fueron de 70 millones 91 mil dólares (en notación americana: $70.09 millones), un 22,96% más que en el mismo período del año previo.
En todo el año fiscal 2010, el distribuidor mayorista de Clearwater, Florida, registró ventas netas por 22 mil 99 millones de dólares (en notación americana: $22.10 billones), 8,23% menos que el año previo. Pero sus ingresos netos de ese mismo período fueron de 180 millones de dólares, 53,61% por encima que en todo el año fiscal 2009.
El análisis de los principales números publicados por Tech Data permite observar que esta compañía creció con firmeza en ventas e ingresos netos en el cuarto trimestre , y también logró un importante avance en el rubro de ingresos netos a través de todo el año. La única declinación fue en las ventas de los doce meses. Resumiendo, sus resultados fueron positivos, considerando que la crisis económica mundial justamente golpeó fuerte hace un año atrás, en febrero del 2009, cuando este mayorista estaba comenzando su año fiscal.
No obstante lo analizado más arriba, las acciones de Tech Data cayeron durante la jornada bursátil pues sus pronósticos de ventas para el nuevo trimestre fiscal que recién comienza, estuvieron por debajo de las estimaciones de los analistas de Wall Street. Al cierre del día el TECD declinó $2,87, o sea 6,40% para cerrar en $41,97.
NOVELL
Novell recibió una propuesta no solicitada de la firma Elliott Associates L.P para comprar la totalidad de sus acciones a razón de $5.75, es decir por un monto de 1 mil 800 millones de dólares (en notación americana: $1.8 billones). Hasta el momento, Elliott Associates es dueña de un 8,50% de las acciones comunes de Novell. La posible venta del completo paquete accionario del padre de Netware y actual dueño de Linux SUSE abre interrogantes sobre cual será su futuro si la transación se concreta.
TECH WALL STREET
Los mercados de Nueva York finalizaron la segunda jornada bursátil del mes de marzo con resultados mixtos. No obstante, los principales índices de Wall Street cerraron en alza. Las variaciones de esos índices estuvieron en el rango +0,50% y +0,02%.
Al cierre del martes 2 de marzo, Dow Jones Industrials Average subió 2,19 puntos, o sea 0,02% para cerrar en 10405,98. Nasdaq Composite ganó 7,22 puntos, o sea 0,32%, cerrando en 2280,79. S&P 500 se movió hacia arriba 0,23%, y NYSE ganó 0,50%.
En el sector de tecnología, Morgan Stanley High Tech subió 0,08%, Philadelphia Semiconductor declinó 0,03%.
Las acciones estrellas del 2009 finalizaron el día con los siguientes resultas :
- Google ganó $8,37, o sea 1,57%, para cerrar en $541,06.
- Baidu declinó $4,03, o sea 0,77%, cerrando en $518,88. (La baja de Baidu, le ayudó a Google a recuperar distancia).
- priceline.com creció $2,80, o sea 1,17%, para cerrar en $241,34.
- Apple fue hacia abajo en $0,14 o sea 0,07%, cerrando en $208,85.
En el sector de chips y semiconductores, Applied Materials e Intel bajaron. Qualcomm cerró en territorio positivo.
En el sector de sistemas, computadores, almacenamiento y redes, Dell y Cisco subieron. El resto, IBM, HP, Apple, y EMC declinaron. IBM cerró en $127,42. HP concluyó la sesión en $51,12.
En el sector de software, Adobe, Microsoft, Oracle, y Symantec finalizaron el día en baja.
En el sector de impresión e imagen, Canon subió. Kodak, Lexmark, y Xerox declinaron.
En el sector de servicios de Internet, como se vio más arriba, Google subió y Baidu bajó. Yahoo también cerró en territorio negativo.
En el sector de comercio electrónico, Amazon.com, EBay, y priceline.com, los tres cerraron en alza.
En el sector de telecomunicaciones, AT&T y Sprint Nextel bajaron. Verizon Communications finalizó la jornada en territorio positivo.
.- De 38 empresas representativas de diferentes sectores de la industria de tecnología e Internet, al cierre de los mercados de Nueva York, 12 cerraron en territorio positivo y 22 en territorio negativo.
2.- El mejor crecimiento del grupo fue el de Qualcomm (+6,66%), seguido por LDK Solar (+3,38%).
3.- La peor caída de todo el grupo fue la de Tech Data (-6,40%). Los analistas e inversores no estuvieron conformes con el pronóstico que este distribuidor mayorista hizo para el próximo trimestre.
4.- Bell Micro que recientemente volvió a cotizar en Wall Street, subió $0,09, o sea 2,08%, para cerrar en $4,41.

For the quarter ended on May 29, Research In Motion reported revenue of $4.24 billion, just below the Wall Street consensus of $4.35 billion. The maker shipped 11.2 million smart phones in the quarter, and added 4.9 million net new subscriber accounts. Oracle announced fiscal 2010 four quarter with total revenues of $9.5 billion, up 39% compared year over year. According to the company the quarter was solid in results. White Oracle is going out of all the problems of the Sun Microsystems merger, Research In Motion suffers difficulties for the hard competition of iPhone and the smart-phones based on Android platform.

Days ago, Wall Street posted an article written by Ting-I Tsai in Taipei (Taiwan) that said Acer is confident that it will accomplish its goal of becoming the No. 1 notebook vendor this year despite the economic crisis. The chairman of the PC maker, J.T. Wang thinks revenue in the third quarter will rise 10% to 15% from the second quarter. Also, the company of Taiwan expects personal computer shipments could rise as much as 50% this year. Till now, the leader of the sector is Hewlett-Packard but Acer is growing more than HP in the last quarters.

Novell: Less Revenues, No Net Losses

Novell announced financial results for its second fiscal quarter ended on April 30, 2010. For the quarter, the software company reported net revenue of $204 million, when a year ago it posted $216 million. For the other side, it net income was $19.9 million. In the same period of 2009, it was $15.6 million. Novell sees revenue of $205 million to $210 million in the current quarter, below the average of $210 analysts have been expected. Despite the enterprises are hiring new software and the economy is recovering, Novell doesn't show signs of growth. Some observers expect a potential acquisition of the father of Netware.
